Mediation is a process in which an impartial/neutral person (Mediator) helps the parties involved in a dispute to come together and find an acceptable and workable solution to their problem.
As opposed to litigation, which is in public domain, Mediation is private and confidential. Whatever is said, presented is strictly confidential between the Mediator and the disputing parties.
The terms of agreement in Mediation is decided by the parties themselves. The Mediator is just a facilitator and as such has no role to play in deciding the terms. Hence, the outcome of Mediation is more acceptable to the disputing parties.
Generally, both parties agree on going for mediation as a way of resolving their dispute. However, in certain cases, one party can approach the Mediator. In such a case, the Mediator will approach the other party and try to convince them to join the mediation process.
